FOREWORD
The services provided by LOCK YOUR LUGGAGE by MYLOCKER s.r.l.s. are governed by these "Terms and Conditions of Service".
The "Terms and Conditions of Service" established by LOCK YOUR LUGGAGE by MYLOCKER s.r.l.s. shall be understood and considered an integral part of each and every deposit contract and any other service concluded with the Client and shall not be severable from the contract itself.
DEFINITIONS
The following definitions apply to the "Terms and Conditions of Service" governing the deposit agreement and for any other services concluded with the customer: "we", "us", "our", the "staff in charge" LOCK YOUR LUGGAGE by MYLOCKER s.r.l.s.means MYLOCKER s.r.l.s. and any partners and collaborators of MYLOCKER s.r.l.s.; "Customer(s)", "you" and "your" means the customer who is the holder of a deposit receipt sent by email.
TERMS AND CONDITIONS
The contract for storage and other services is made with the Company MYLOCKER s.r.l.s., the owner of www.lockyourluggage.com, which agrees to stow its customers' luggage/objects in its luggage storage facilities. By leaving luggage on our premises and in the luggage room, you agree to the terms and conditions set forth in our storage contract and/or contract for the provision of various services, on your own behalf and/or on behalf of any other interested person.
SERVICE DESCRIPTION
The luggage storage service consists of the rental provision of automatic lockers for the storage of luggage/personal items at our stores for the period chosen by the customer at the time of booking.
It is the Client's responsibility not to leave in the locker any identification or other documents necessary for travel. The Client acknowledges that he/she has taken all necessary precautions and measures to ensure that he/she has not left in the locker any documents necessary for travel. Failing this, MYLOCKER s.r.l.s. in no event shall be held liable for any negligence on the part of the Client.
LATE PICKUP IN THE BAGGAGE ROOM
In case of late baggage pick-up during working hours (of the baggage store), MYLOCKER s.r.l.s. will charge an additional fee for each time slot of delay. Upon completion of the payment, the Client will be able to collect the luggage.
If the pickup does not (take place) took place before the closing time of the store, but on the following day(s), MYLOCKER s.r.l. will charge an additional fee for each time slot or daily delay. Upon completion of payment, the Customer will be able to collect the luggage.
FORGOTTEN/FOUND LUGGAGE
For security reasons, any item or luggage that is forgotten/found and unclaimed will be destroyed after 5 days from the end of the reservation.
Items forgotten in the baggage room will not be possible to be shipped.
PROHIBITED AND DANGEROUS ITEMS
Items prohibited by law and/or considered dangerous under national legislation, as well as items that by their nature or packaging may cause harm to people, the environment or other baggage being transported and/or deposited are not allowed to be stored.
We do not accept storage, nor do we provide other services for goods that in our sole discretion are considered dangerous.
Lock Your Luggage by MYLOCKER s.r.l.. does not accept deposit for the following items: plants and animals, live or dead; negotiable securities and certificates (bills of lading, currencies, banknotes, coins, credit cards and travelers checks (travel documents)); other non-negotiable securities; any material that could be considered pornographic or indecent; weapons (firearms and edged weapons); software containing high-value information; technology (phones, tablets, PCs, smartphones); trash; political material; hazardous materials; narcotics or psychotropic drugs; art objects; antiques; metals (gold, silver in any form and precious stones); bulky goods; documents (public and private bids, securities, food stamps and fuel vouchers, etc.); watches.
The following items may be accepted by MYLOCKER s.r.l.s. only with specific written permission or if they are expressly part of MYLOCKER s.r.l.s.'s business offerings:food and pharmaceutical products; cigarettes and alcohol; fragile items (such as glass, bottles, etc.); biological tissues and anatomical pieces.
The customer acknowledges and accepts that the storage of such goods is subject to specific regulations. Entrustment must, therefore, take place in accordance with current regulations and any operational provisions dictated by MYLOCKER s.r.l.s..These indications may change at any time.
RIGHT OF INSPECTION
The Client acknowledges and agrees that MYLOCKER s.r.l. and/or any Governmental Authority has the right to open and inspect baggage at any time for security reasons.
OBLIGATIONS OF THE CLIENT
The customer warrants and represents that:
(A) the contents of the baggage have been safely and carefully packed so as to be protected from the normal hazards of transportation, including any associated sorting and/or handling process;
(B) the contents of the baggage do not cause damage to other baggage carried by us and/or stored at our depots;
(C) the contents of the luggage is not a prohibited item and the customer a person or organization with whom we cannot legally trade under applicable laws or regulations;
(D) when you have requested to charge a third party for the storage fee, in case of non-payment, you will be obliged to pay the service charge;
(E) all applicable laws and regulations have been complied with, in addition to the provisions of this contract;
(F) the economic value of each piece of luggage including its contents does not exceed €1,000.
he customer implicitly agrees to indemnify us and to hold us harmless from any liability we may incur, or from any costs, damages, or expenses, including attorneys' fees, that we may incur for you or any third party and arising out of your breach of any of these warranties, obligations, and guarantees, even if we inadvertently accept a retention that contravenes any of your obligations.
EXTENT OF OUR RESPONSIBILITY
Lock Your Luggage by MYLOCKER s.r.l. is not liable in any case, for any object or money contained within the luggage. The customer is therefore responsible for his or her luggage and what is contained in it.
No responsibility is attributable to MYLOCKER s.r.l.s. in case of baggage(s) delayed and/or not picked up after the opening/closing hours of our premises.
Therefore, MYLOCKER s.r.l.s. shall in no way be liable in connection with duly and fully proven damages that may be deemed a direct and foreseeable or indirect consequence of the delay and/or failure to collect.
MYLOCKER s.r.l.s. will therefore not be liable for any flight, train, start-up, loss of revenue, profit, market, reputation, customers, use, opportunity, even if we had knowledge that such loss or damage might occur, nor for any loss or damage, regardless of indirect, incidental, special or consequential damages determined, including but not limited to, instances of termination of contract, negligence, willful misconduct or default. We will not be liable if we fail to perform any obligation to you due to circumstances beyond our control such as (the following list is purely illustrative and not exhaustive): force majeure including earthquakes, cyclones, storms, floods, fires, disease, fog, snow, or frost; force majeure including (but not limited to) war, accidents, acts of terrorism, strikes, embargoes, local disputes, or popular uprisings; national or local disruptions; hidden defects or inherent defects in the contents of checked baggage; criminal acts of a third party such as theft, robbery, and arson; acts or omissions attributable to you or a third party for which you will be responsible for the work; act or omission attributable to a public official; contents of the shipment consisting of any item that is an item prohibited by law or under the provisions of this contract, even though we may have accepted the shipment and/or deposit in error. We are not responsible for broken handles and/or wheels. Our only liability in connection with the services provided is governed by these general conditions of storage.
COMPLAINTS, DISPUTES
If a customer wishes to file a complaint for lost or damaged luggage, or for any other damage, he or she must follow the provisions of national law; otherwise, we reserve the right to reject the complaint. Specifically, you may submit your complaint in writing within eight (8) calendar days from the date the locker rental ends. After the first written notice, and no later than the statute of limitations prescribed by law or applicable regulations, the customer must provide documentary evidence of the claim by sending all relevant information related to the claim. We are not obligated to act on any claim until our filing fees and expenses have been paid. The customer has the right to deduct the amount of the claim from the amounts due for rental to MYLOCKER s.r.l.s. In order to take into account a claim for damages, the contents of your luggage will be made available to us for inspection upon collection. In the event of our acceptance of the claim, you warrant that the insurance company or third party having an interest in the storage will waive any right or claim to which they are entitled under subrogation or otherwise.
RATES AND PAYMENT TERMS
For automatic locker rental service, your credit card will be charged at the time of online or on-site purchase. This charge will include the cost of the rented time slot and for online reservations a charge per reservation fee of €1.00.
Any disputes regarding charges must be received by us in writing no later than seven (7) days from the date of payment. Current rates applicable to the deposit service are available from our stores on our websites. The customer agrees to pay the amount due to MYLOCKER s.r.l.s. governed by these conditions within the agreed terms. Payments will be made in the local currency, and calculated according to the current exchange rate. Late payments may result in the application of default interest pursuant to Legislative Decree No. 231/02, as amended. MYLOCKER s.r.l.s. reserves the right to demand, without prejudice, the reimbursement of its credits in the time and manner provided by law, without prejudice to the right to greater damages.
APPLICABLE LAW
Should any term or condition of this Agreement be declared invalid or unenforceable, such determination shall not affect the other provisions of this Deposit Agreement, which shall then remain in full force and effect. Except for the provisions of any applicable rule; any dispute arising out of and/or related to this Deposit Agreement shall be governed by Italian law.
JURISDICTION
Any dispute relating to the relationship between the parties will be the exclusive jurisdiction of the consumer's court pursuant to Article 33 paragraph 2 of Legislative Decree No. 206/2005, as amended.
SERVICE DESCRIPTION: The luggage storage service consists of lockers located within this venue and suitable for holding luggage for a period ranging from a minimum of one hour to a maximum of 30 days. 1 - Rates for luggage storage and storage are determined by Lock Your Luggage and are prominently displayed both on the site and inside the premises. 2 - Lock Your Luggage is not liable, under any circumstances, for any items or money contained within the luggage. Customers are therefore responsible for their luggage and what is contained in it. 3 - It is forbidden to deposit plants or animals, dead or alive, luggage containing goods or materials that are easily inflammable, easily perishable, exhaling foul odors, prohibited by law or that may otherwise cause deterioration of the luggage room infrastructure or damage to other luggage deposited. 4 - Lock Your Luggage is open daily from 7:00 am to 11:00 pm. Please retrieve your luggage before the closing time of the facility. Otherwise, you will only be able to access it the next day for an extra fee. 5 - Lock Your Luggage is under 24-hour video surveillance 6 - Lock Your Luggage premises are strictly non-smoking. 7 - Use of Lock Your Luggage is permitted only by those over the age of 18 or accompanied minors. 8 - Payment for the service is accepted only by credit or debit card. 9 - Please re-seal the box properly after use, or you will be charged an additional €20.00. 10 - In addition to employees and those in charge of control and management of the service, law enforcement officials are also allowed access to the premises at all times if the request is motivated by service and/or security needs. 11 - For security reasons, any forgotten and unclaimed items or luggage will be automatically destroyed after 5 days from the end of locker use. 12 - Lock Your Luggage reserves the right to take any action it deems necessary in the event of misuse and/or damage to its capital goods in the availability of customers. 13 - No claims will be accepted and no refunds will be issued in case of non-compliant luggage and/or lockers. 14 - By payment, you fully accept all the conditions set forth in these rules, which may be modified by Lock Your Luggage at any time. 15 - For any legal dispute, the place of jurisdiction will be Frosinone. 16 - As reported on our premises, it is forbidden to leave garbage and dirt. In case of abandoned garbage in the premises, the company is authorized to require the customer, who has violated this rule, to pay ( by bank transfer ) a fine of a sum equal to 5€ ( vat excluded ).
